FINRA was investigating Miller after he was fired from his brokerage firm, Securities America, Inc., for allegedly failing to follow firm policies and procedures regarding unit investment trusts, or UITs, according to a recent FINRA Letter of Acceptance, Waiver and Consent (AWC).

Derek Lee Miller, of Redondo Beach, California, was a financial advisor and registered representative of Securities America, Inc. from March 2013 to October 2014, and also was affiliated with Cambridge Investment Research from June 2010 to March 2013, the AWC notes.

Derek Lee Miller received a letter from FINRA on July 10, 2015 in connection with an investigation into potential unsuitable trading, and FINRA staff also sent a letter to Miller, pursuant to FINRA Rules requesting that he appear on August 4, 2015 to provide on-the-record testimony, according to the AWC.

By refusing to appear for on-the-record testimony as requested pursuant to FINRA Rules, Miller violated FINRA Rules, the AWC reports.

Hence, Miller has been barred from association, in any and all capacities, with any FINRA member firm, according to the AWC.
