Metals, Millings and Mining LLC Notes Were Fraudulently Sold, According to Securities Regulators

Ponzi scheme recovery attorneysJonah Engler, Brett Ian Friedberg, Jonathon Michael Sheklow, Joshua William Turney, Hector Perez (also known as Bruce Johnson), and Joshua Scott Schaffer fraudulently sold a total of nearly $3 million worth of Senior Secured Zero Coupon Notes issued by Metals, Milling and Mining LLC in a private placement offering to 59 customers, according to a complaint filed by the Financial Industry Regulatory Authority’s Department of Enforcement.

The Peiffer Rosca securities practice attorneys Alan Rosca and Joe Peiffer are investigating the matter.

Engler, Friedberg, Sheklow, Turney, Perez, and Schaffer misrepresented material facts about the offering, which promised to pay a return of 100 percent in one year by purportedly extracting precious metals from materials left over from mining operations, according to the complaint.

Investors lost all of the money they invested in the notes, with the exception of three investors who were repaid in a Ponzi-like manner with funds from new investors, according to the complaint.

Engler, Friedberg, Sheklow, Turney, Perez, and Schaffer are accused of failing to conduct a reasonable investigation of the viability and legitimacy of the notes issued by Metals, Milling and Mining in the face of numerous “red flags” that the company was a fraud, according to the complaint.

The Peiffer Rosca securities attorneys often represent investors who lose money as a result of Ponzi schemes, investment fraud, or stockbroker misconduct. They are currently investigating the possibility of assisting victims with the recovery of their losses. They take most cases of this type on a contingency fee basis and advance the case costs, and only get paid for their fees and costs out of money they recover for their clients.
